Understanding the DOT Compliance Review

A DOT compliance review is an on-site examination of your motor carrier operations by FMCSA or state enforcement. It evaluates your compliance with the Federal Motor Carrier Safety Regulations (FMCSRs) and may result in a safety rating of Satisfactory, Conditional, or Unsatisfactory. New entrant carriers receive a safety audit within their first 18 months of operation. Use this checklist to prepare proactively rather than scrambling when the auditor arrives.

Pre-Audit Administrative Preparation

  • Designate a point of contact: Assign a compliance manager or safety director who will meet the auditor and coordinate document retrieval

Audit every active driver file against 49 CFR Part 391. Each file must contain:

  1. Completed employment application (past 10 years of employment history)
  2. Motor vehicle record (MVR) from every licensing state—initial and annual updates
  3. Road test certificate or 3-year experience waiver
  4. Current medical examiner's certificate (verify against National Registry)
  5. Annual review of driving record signed by a company official
  6. Previous employer safety performance history for 3 years
  7. FMCSA Drug and Alcohol Clearinghouse pre-employment full query
  8. Annual limited Clearinghouse query
  9. Copy of CDL with proper class and endorsements
  10. Entry-Level Driver Training (ELDT) certification for applicable drivers

Vehicle Maintenance Records Checklist

Verify compliance with 49 CFR Part 396:

  • Current annual inspection for every vehicle (within 12 months)
  • Documented systematic maintenance program
  • Maintenance records retained for 1 year minimum plus 6 months after vehicle leaves fleet
  • DVIR process: driver reports filed, defects repaired, sign-offs documented
  • Brake inspector qualifications on file
  • Intermodal equipment provider records (if applicable)

Cross-reference your vehicle files with inspection data to identify units with recurring defects that need additional attention before the audit.

Hours-of-Service Documentation Checklist

  • ELD system registered with FMCSA and on the approved list
  • ELD supporting documents available for the past 6 months (fuel receipts, bills of lading, dispatch records)
  • Driver training records documenting ELD instruction
  • Unassigned driving events reviewed and resolved within 14 days
  • Records of ELD malfunctions and data transfer capability
  • Supporting document retention for 6 months

Drug and Alcohol Program Checklist

  • Written drug and alcohol policy distributed to all drivers with signed acknowledgment
  • Current consortium or TPA agreement on file
  • Random testing selection records meeting required rates (25% drugs, 10% alcohol)
  • Supervisor reasonable-suspicion training documentation (60 min drugs, 60 min alcohol)
  • Pre-employment testing results for all hires
  • Post-accident testing protocol documented and followed
  • Clearinghouse reporting up to date for any violations
  • SAP (Substance Abuse Professional) process documented if any violations occurred

Insurance and Authority Documentation

  • Current USDOT number and MC/FF/MX authority
  • BOC-3 process agent designation on file
  • Proof of insurance meeting minimum requirements ($750K/$1M/$5M depending on cargo)
  • IFTA and IRP credentials current
  • UCR (Unified Carrier Registration) paid for the current year

Day-of Audit Tips

When the auditor arrives, be professional, cooperative, and organized. Provide only what is requested—do not volunteer additional information or problems. Have your violation records and inspection history reviewed in advance so you can speak knowledgeably about your corrective actions. An auditor who sees a carrier that takes compliance seriously is more likely to view borderline findings favorably.
