BOC-3 Process Agents

What is a BOC-3?

Form BOC-3 — Designation of Agents for Service of Process — is a filing with FMCSA that names a person or company in each state who is authorized to receive legal documents (such as lawsuits or subpoenas) on behalf of a motor carrier, broker, or freight forwarder. The designation ensures that a carrier can be served legal process in any state where it operates, even if it has no physical presence there.

Why It's Required

BOC-3 filings are required under 49 CFR 366 for all carriers, brokers, and freight forwarders that hold or are applying for operating authority. Without a valid BOC-3 on file, FMCSA will not grant operating authority. The requirement ensures that anyone with a legal claim against a carrier can serve process in their own state rather than having to locate the carrier in its home state.

Types of BOC-3 Designations

There are two types of process agent designations:

• Blanket agent: A single company or service that covers all states through one filing. This is the most common and cost-effective option, typically costing $50 to $200.
• Individual agent: A separate agent designated for each state. This requires individual filings per state and is rarely used by new carriers.
