VEHICLE SPEED CONTROL
Owner Narrative
The contact owns a 2007 Toyota Tundra. The contact initially received a recall notice for NHTSA Campaign Number: 09V388000(Vehicle Speed Control); the vehicle was taken to the dealer and the recall was serviced. Recently, the contact stated that as his wife was exiting their driveway, the vehicle independently accelerated without warning. The contact's wife turned the vehicle into her yard where she hit four trees and then crashed into a big tree which stopped the vehicle. The air bags deployed once she crashed into the bigger tree. The contact's wife was thrown to the right and hit her head on the rearview mirror. His wife was taken to the hospital by ambulance where she was treated for the head wound and back pain. She later sought treatment from an orthopedic doctor where they discovered three compressed fractures to her vertebrae(T1, T2, and T3). A police report was filed. The contact did his own investigation into the accident and discovered that black box had recorded that the vehicle's speed was 42.3 MPH at the time of the failure. Both the dealer and the manufacturer were notified of the failure but both offered no assistance. The vehicle remained in the contact's possession. The vehicle had yet to be repaired. The failure mileage was approximately 164,000.
