Form BOC-3 — Designation of Agents for Service of Process — is the FMCSA filing every motor carrier, broker, and freight forwarder operating in interstate commerce must keep on record. Federal regulation 49 CFR § 366.4 requires the designation to cover every state the carrier operates in: a single "blanket" agent can satisfy the requirement nationwide, or different agents can be named for individual states.
Only a registered process agent — not the carrier itself — can submit Form BOC-3 to FMCSA. Once filed, the designation becomes effective immediately and stays in force until canceled. Cancellation triggers automatic revocation of operating authority 30 days later unless a replacement BOC-3 is on file. Most carriers re-file BOC-3 only when switching agents or when an agent goes out of business.
